Cancellation policy (Applies only to consumers within the meaning of § 13 BGB (German Civil Code))

Right of Cancellation

Consumers have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods (or the last goods in the case of a contract for multiple goods delivered separately).

To exercise your right of cancellation, you must inform us

by means of a clear declaration (e.g., a letter sent by post, fax, or email) of your decision to cancel this contract. You may use the attached model cancellation form, which is, however, not mandatory.

Digital Cancellation Function (Withdrawal Button): You can also exercise your right of cancellation electronically via the button provided on our website ("Cancel Contract") at https://www.swm-maschinen.de/withdrawal/. If you make use of this option, we will transmit to you an acknowledgment of receipt of such a cancellation immediately (e.g., by email).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

Return Costs: You bear the direct costs of returning the goods. Since the goods cannot be returned by regular post due to their nature (heavy machinery), the cost of return is estimated at a maximum of approximately EUR 250.00 within Germany and a maximum of approximately EUR 450.00 from other EU countries (e.g., Austria, France, Benelux).

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
